Privacy Policy
1. Who We Are and Scope of This Policy
This Privacy Policy ("Policy") is issued by Optimal Health Network LLC, a Delaware limited liability company located in Lewes, Delaware, doing business as Urgent Care Online (also known as Urgent-Care-Online), the owner and operator of the website Urgent-Care-Online.com (collectively, "Urgent Care Online," "we," "us," or "our"). References to "Urgent Care Online" in this Policy include Optimal Health Network LLC, Urgent-Care-Online, Urgent-Care-Online.com, and our affiliates, successors, and assigns.
This Policy describes how we collect, use, disclose, retain, and protect information when you:
- visit Urgent-Care-Online.com (including all subdomains and successor domains) or any website, landing page, or form that links to this Policy (collectively, the "Site");
- submit your information to us through a form on the Site or through one of our advertising, co-registration, or marketing partners who present our offer and this Policy to you ("Partner Forms");
- communicate with us by telephone, text message (SMS/MMS), email, or chat; or
- otherwise interact with our marketing, lead-matching, and referral services (together with the Site and Partner Forms, the "Services").
By using the Services, submitting a form, or otherwise providing information to us, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, do not use the Services or provide us with your information.
This Policy is incorporated by reference into, and should be read together with, our Terms of Use, which contain important limitations of liability, a binding arbitration agreement, and a class-action waiver.
1.1 What Urgent Care Online Is — and Is Not
Urgent Care Online is a marketing, lead-generation, and referral service. We help connect consumers who have expressed interest in urgent care, connecting with a doctor, insurance, or related health and wellness products and services with providers, insurers, agents, and other businesses that offer those products and services.
Urgent Care Online is not a healthcare provider, medical practice, clinic, health plan, insurer, insurance agency, or pharmacy unless expressly stated otherwise in writing. We do not provide medical advice, diagnosis, or treatment. Unless we have separately entered into a Business Associate Agreement with a covered entity, we are not a "covered entity" or "business associate" under the Health Insurance Portability and Accountability Act ("HIPAA"), and the information you provide to us is not "protected health information" governed by HIPAA. Any information you provide is governed by this Policy and applicable consumer privacy laws rather than HIPAA. Providers and insurers to whom we refer you will have their own privacy practices, including any HIPAA notices, which govern information you provide directly to them.
2. Information We Collect
2.1 Information You Provide Directly
When you complete a form on the Site or a Partner Form, request a call back, request an insurance eligibility check, or otherwise contact us, we may collect:
- Identifiers and contact information: first and last name, postal address, ZIP code, email address, telephone number(s) (including mobile number), and IP address.
- Demographic information: date of birth, age, gender, household size, and ZIP code.
- Insurance information: whether you have health insurance, insurance carrier or plan name, plan type, member or subscriber ID, group number, policyholder name and date of birth, coverage dates, and whether you are enrolled in Medicare, Medicaid, or a marketplace plan.
- Health-related interest information: the type of care or service you are inquiring about, symptoms or conditions you choose to describe, preferred appointment timing, and whether you are seeking care for yourself or a dependent.
- Communication preferences and consents: your telephone, text-message, and email consent elections, the exact disclosure text you were shown, and the date, time, and manner in which you provided consent.
- Content of communications: the content of emails, text messages, chats, voicemails, and (where permitted by law) recordings or transcripts of telephone calls with us.
- Any other information you choose to provide.
You are not required to provide any information; however, if you do not, we may be unable to provide the Services you request.
2.2 Information We Collect Automatically
When you access the Site, we and our service providers automatically collect certain information using cookies, pixels, tags, software development kits, session-replay tools, local storage, and similar technologies ("Tracking Technologies"), including:
- device type, operating system, browser type and version, screen resolution, and language settings;
- IP address, approximate geolocation derived from IP address, and Internet service provider;
- referring and exit URLs, pages viewed, links clicked, form fields interacted with, time spent, and the date and time of your visit;
- advertising identifiers, click IDs, campaign source, and attribution data; and
- consent-evidence data, such as a time-stamped record or visual snapshot of the form page as it appeared when you submitted it, your IP address, user agent, and the unique identifier assigned to your submission. We retain this information to document your consent as required by law.
See Section 7 (Cookies and Tracking Technologies) for more information and your choices.
2.3 Information We Receive From Third Parties
- Co-registration and advertising partners. Many consumers reach us through third-party websites, surveys, sweepstakes, comparison-shopping sites, or offer pages operated by our marketing and co-registration partners ("Partners"). When you select or opt in to an Urgent Care Online offer on a Partner's site, that Partner transmits to us the information you entered, along with your consent record and the URL of the page where you provided it. Partners are independent of us and are responsible for their own privacy practices.
- Lead-verification and data-enhancement vendors. We may receive information from vendors that validate phone numbers and addresses, confirm line type (mobile vs. landline), check numbers against Do-Not-Call and litigator lists, detect fraud, or append or correct demographic data.
- Insurance eligibility and verification services. As described in Section 3, we may receive coverage and eligibility information from insurers and eligibility clearinghouses.
- Public and commercially available sources, social-media platforms (if you interact with us there), and analytics and advertising networks.
We may combine information from these sources with information you provide to us directly.
3. Insurance Eligibility Verification
If you request an insurance eligibility check, indicate that you have insurance, or ask us to match you with a provider or plan based on your coverage, you authorize us and our service providers to use the insurance information you provide (such as your name, date of birth, carrier, and member ID) to verify your coverage with the applicable insurer, health plan, government program, or a third-party eligibility clearinghouse ("Eligibility Services").
In connection with an eligibility check, we may receive from Eligibility Services information such as whether your coverage is active, plan type and network, effective and termination dates, copayment, deductible, and coinsurance information, and whether a particular provider or service is covered. We use this information to determine which providers, plans, or Partners may be appropriate for you, to route your inquiry, and to communicate with you about your options.
Please note:
- An eligibility check is informational only. We do not guarantee the accuracy, completeness, or timeliness of information returned by insurers or Eligibility Services, and we are not responsible for any decision you make, or any charge you incur, in reliance on eligibility information. Always confirm coverage directly with your insurer and provider before receiving care.
- Insurance information is not required to use the Services.
- Insurance information is treated as sensitive information under this Policy (see Section 4 and Section 10).
4. Consumer Health Data Notice
Some information we collect may be considered "consumer health data," "sensitive data," or "sensitive personal information" under state laws, including the Washington My Health My Data Act, the Nevada Consumer Health Data Privacy Law, the Connecticut Data Privacy Act, and the California Consumer Privacy Act. This may include the type of care you are seeking, conditions or symptoms you describe, and your insurance information.
We collect and use consumer health data only with your consent or as otherwise permitted by law, and only for the purposes described in this Policy. We do not sell consumer health data without your separate, valid authorization where such authorization is required by law. Where state law requires, we will obtain your affirmative consent before collecting or sharing consumer health data for purposes beyond those necessary to provide the Services you requested. You may withdraw consent or exercise your rights with respect to consumer health data as described in Section 10. We do not use geofencing around healthcare facilities to identify, track, or send notifications to consumers.
5. How We Use Information
We use the information we collect for the following purposes (and for any other purpose disclosed to you at the time of collection):
- To provide the Services you request, including matching and referring you to physicians, urgent care clinics, medical practices, insurers, agents, and other Partners; scheduling or facilitating appointments; and performing insurance eligibility checks.
- To contact you by telephone, text message, email, and mail about your inquiry, our Services, and products and services of our Partners that we believe may interest you — including by means of an automatic telephone dialing system, prerecorded or artificial voice message, and AI-generated voice, where you have provided the consent described in Section 6.
- To verify your identity and information, prevent fraud, confirm consent, and comply with legal and contractual obligations.
- To operate, maintain, analyze, and improve the Site and Services, including measuring campaign performance, testing new features, and troubleshooting.
- For advertising and marketing, including interest-based advertising, retargeting, lookalike audiences, and measuring the effectiveness of our advertising across websites, apps, and devices.
- To comply with law and protect rights, including responding to subpoenas, court orders, and lawful requests; enforcing our Terms of Use; defending legal claims; and protecting the rights, property, and safety of Urgent Care Online, our users, Partners, and the public.
- For business transfers, as described in Section 8.
- To create de-identified or aggregated data, which we may use and disclose for any purpose. We commit to maintain and use such data only in de-identified form and not to attempt to re-identify it, except as permitted by law to test de-identification.
6. Telephone Calls, Text Messages, and Autodialed Communications
6.1 Your Consent to Be Contacted
When you submit a form on the Site or a Partner Form containing an Urgent Care Online offer and check the consent box or take the affirmative action described in the disclosure, you provide your prior express written consent (electronic signature) to receive marketing and informational telephone calls and text messages from Urgent Care Online and, where disclosed on the form, from our named Partners, at the telephone number(s) you provided, including:
- calls and texts placed using an automatic telephone dialing system or other automated dialing technology;
- calls delivering an artificial, prerecorded, or AI-generated voice message;
- SMS and MMS text messages, including automated and recurring messages; and
- calls and texts to numbers listed on any federal, state, or internal Do-Not-Call registry.
Your consent applies even if the number you provided is a mobile or wireless number, a number you later port to a wireless service, or a number for which you incur charges. Message and data rates may apply. Message frequency varies.
Consent is not a condition of purchase or of receiving any product or service. You may use the Services without consenting to automated calls or texts by emailing us at support@urgent-care-online.com.
The exact consent language presented to you, together with the date, time, IP address, and page on which you provided it, is recorded and retained by us as described in Section 2.2.
6.2 Who May Contact You
Calls and texts may be placed by Urgent Care Online, by Urgent Care Online and its affiliates, by vendors or call centers acting on our behalf, and by the Partners specifically identified on the form you completed. If you did not see a company named on the consent disclosure, that company has not received your consent from us. A current list of Partners who may contact you based on our forms is available at https://www.urgent-care-online.com/partners and is incorporated into the applicable consent disclosure.
6.3 Calling Hours
We will not place telemarketing calls or send marketing texts to you before 8:00 a.m. or after 9:00 p.m. in your local time zone, and we observe any more restrictive hours required by the laws of your state.
6.4 Call Monitoring and Recording
Calls to and from Urgent Care Online may be monitored and recorded for quality assurance, training, compliance, consent verification, and dispute resolution. By continuing a call after notice of recording, you consent to such recording. If you do not wish to be recorded, inform the representative and end the call.
6.5 How to Revoke Consent or Opt Out
You may withdraw your consent to receive calls and texts at any time through any reasonable means, including:
- replying STOP, QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT to any text message;
- telling a representative during a call that you wish to stop receiving calls;
- emailing privacy@urgent-care-online.com with the phone number you want removed; or
- using the "Do Not Call / Do Not Text" form at https://www.urgent-care-online.com/do-not-call.
We will honor your request within ten (10) business days or any shorter period required by law. After you text STOP, you may receive one final confirmation message. Revoking consent for text messages does not automatically revoke consent for telephone calls, and vice versa, unless you tell us to stop all contact; we encourage you to specify the channels you wish to stop. Revocation does not apply to Partners who separately obtained your consent and to whom your information was already transmitted before your request; you may need to contact those Partners directly, and we will provide you with their contact information upon request.
6.6 SMS Program Terms
Program name: Urgent Care Online Alerts. Description: Recurring automated marketing and informational messages about urgent care, doctor connections, and insurance options related to your inquiry. Message frequency varies. Message and data rates may apply. Text HELP for help or STOP to cancel. Carriers are not liable for delayed or undelivered messages. Mobile information will not be shared with third parties or affiliates for their own marketing or promotional purposes without your consent as described in this Policy.
7. Cookies and Tracking Technologies
We and our service providers use Tracking Technologies to operate the Site, remember your preferences, analyze traffic, document consent, detect fraud, and deliver and measure advertising. Technologies we may use include first- and third-party cookies, web beacons/pixels (e.g., Meta Pixel, Google Ads, TikTok, Microsoft Advertising), analytics tools (e.g., Google Analytics), session-replay and form-analytics tools, tag managers, and consent-documentation scripts (e.g., TrustedForm, Jornaya/LeadiD).
Your choices:
- Browser settings. Most browsers allow you to block or delete cookies. Doing so may impair Site functionality.
- Opt-out of interest-based advertising. Visit the Digital Advertising Alliance at optout.aboutads.info, the Network Advertising Initiative at optout.networkadvertising.org, or youradchoices.com. To opt out of Google Analytics, install the Google Analytics Opt-out Browser Add-on.
- Global Privacy Control. We honor Global Privacy Control ("GPC") signals as a request to opt out of the sale or sharing of personal information for the browser or device from which the signal is sent, to the extent required by applicable law. Other "Do Not Track" signals are not honored because no uniform standard exists.
- Cookie preferences. Where available, use the cookie banner or "Your Privacy Choices" link on the Site.
8. How We Disclose Information
We may disclose each category of information described in Section 2 to the following categories of recipients:
| Recipient category | Purpose |
|---|---|
| Physicians, healthcare providers, clinics, medical practices, insurers, insurance agents and agencies, and other Partners | To fulfill your request for care, coverage, quotes, or information; to allow them to contact you where you consented. This constitutes a "sale" or "sharing" of personal information under some state laws; you may opt out under Section 10. |
| Co-registration, advertising, and lead-distribution networks | To deliver, match, and route your inquiry; to attribute and measure campaigns. Constitutes a "sale" under some state laws. |
| Service providers and contractors | Hosting, CRM, dialing and telephony platforms, SMS gateways, call centers, email providers, analytics, consent-documentation vendors, lead-validation and compliance vendors, payment processors, and professional advisors, each bound to use the information only on our behalf. |
| Insurance eligibility clearinghouses and insurers | To perform insurance eligibility checks you request (Section 3). |
| Advertising and analytics partners | Interest-based advertising, measurement, and attribution through Tracking Technologies (Section 7). Constitutes "sharing" for cross-context behavioral advertising under California law. |
| Affiliates | Entities under common ownership or control with Optimal Health Network LLC, including Optimal Health Network (optimalhn.com), for purposes consistent with this Policy. |
| Government, law enforcement, courts, and parties to litigation | When required by law, subpoena, court order, or governmental request; to establish, exercise, or defend legal claims; to investigate fraud or security issues; or to protect rights, property, or safety. |
| Successors in a business transaction | In connection with any actual or proposed merger, acquisition, financing, reorganization, bankruptcy, receivership, or sale of all or part of our assets, your information may be transferred as a business asset, subject to standard confidentiality protections. |
| Others with your consent or at your direction. |
Compensation. We may receive compensation from Partners when we transmit your inquiry to them or when you purchase products or services from them. Partners are independent businesses; we do not control, and are not responsible for, their privacy practices, communications, products, services, pricing, or compliance with law. Once your information is transmitted to a Partner, that Partner's privacy policy governs its use.
9. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to satisfy legal, accounting, tax, and compliance obligations; to resolve disputes; and to enforce our agreements. In particular:
- Consent records (including form snapshots, IP addresses, timestamps, and the disclosure text presented) are retained for at least five (5) years after the last communication, consistent with the statute of limitations applicable to telephone-marketing claims, so that we can demonstrate your consent if required.
- Do-Not-Call and opt-out requests are retained indefinitely so that we can continue to honor them.
- Call recordings are retained for two (2) years unless needed for a dispute or legal hold.
- Insurance eligibility responses are retained for ninety (90) days after your inquiry unless needed to fulfill an ongoing referral.
When information is no longer needed, we delete, de-identify, or securely destroy it.
10. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights with respect to your personal information under laws such as the California Consumer Privacy Act (as amended by the CPRA), the Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Indiana, Tennessee, Delaware, New Jersey, New Hampshire, Nebraska, Kentucky, Maryland, Minnesota, and Rhode Island consumer privacy laws, and the Washington and Nevada consumer health data laws:
- Right to know / access — to confirm whether we process your personal information and to receive a copy of it, including the categories of sources, purposes, and third-party recipients.
- Right to correct inaccurate personal information.
- Right to delete personal information, subject to legal exceptions (for example, we may retain opt-out records and consent evidence to comply with law and defend legal claims).
- Right to data portability — to receive your information in a portable, readily usable format.
- Right to opt out of the sale or sharing of personal information, of targeted advertising, and of profiling in furtherance of decisions that produce legal or similarly significant effects.
- Right to limit the use and disclosure of sensitive personal information to purposes necessary to provide the Services.
- Right to withdraw consent to the processing of sensitive data or consumer health data.
- Right to non-discrimination — we will not deny you services, charge different prices, or provide a different level of quality because you exercised your rights, except as permitted by law.
